A recap of the new procedures which come into force on 1 April 2016.

New procedures for the Jersey Employment and Discrimination Tribunal (JEDT) will come into force on 1 April 2016.  The Employment and Discrimination Tribunal (Procedure) Order 2016 usefully sets out in one place the Tribunal’s process from start to finish. Some of the rules contained in the Order replicate current process contained in Guidance Notes. This includes, for example, the requirement to file a response to a claim within 21 days. However, some interesting new aspects to the rules include:

  • The ability of the Tribunal to determine how it should hear 2 or more claims that give rise to common related issues.
  • The power of the Tribunal to make unless orders. An unless order is a particular type of order requiring that something is done by a specified date, otherwise a claim or response (either fully or partially) will be dismissed without further order.
  • The ability to conduct hearings by electronic communications, which means we may see more case management hearings conducted by telephone in the future.
